Governor Cuomo signs "Driver and Family Protection Act."

By Daneil Flanzig

Governor Cuomo has just signed into law the Supplementary Uninsured/Underinsured Motorist (SUM) bill S5644B/ A8519A — also known as the "Driver and Family Protection Act." This important piece of legislation will protect New Yorkers statewide who are involved in auto accidents with drivers who are uninsured or underinsured.

This is a very big deal for NY Cyclists as well as anyone else who lives, rides or drives in NY.

This is a very big deal for NY Cyclists as well as anyone else who lives, rides or drives in NY. SUM insurance is so important that, after the work performed by the New York State Trials Lawyers Assoc., who advocated for this bill, the Governor and the New York legislature required Transportation Network Companies (Uber, Lyft and other "rideshare" companies when operating outside NYC) to establish SUM insurance coverage for all their rideshare vehicles at $1.25 million, an amount equal to their required general auto insurance liability coverage.

All to many New Yorkers don’t even know about SUM insurance. Every day, New Yorkers suffer because they and their loved ones do not have this protection.

This commonsense new law will require insurance companies to inform their customers about SUM and provide them with a waiver opt-out form for all new policies, notifying them that the coverage will be included in their policy unless they choose not to accept this protection by signing the waiver.

If you live, ride or drive in NY, please check your policy for this important coverage. The cost is nothing compared to the protection you will receive.
